EU Batteries and Waste Batteries Regulation (EU) 2023/1542 for Light Transport Vehicles (LMT) Batteries
On July 12, 2023, the European Commission announced Regulation (EU) 2023/1542, "Batteries and Waste Batteries," which will enter into force on August 17, 2023, repealing the previous Batteries Directive 2006/66/EC on August 18, 2025. EU Regulation (EU) 2023/1542 primarily addresses the sustainability of batteries and related requirements. This new regulation, which will apply from February 18, 2024, provides specific requirements for various types of batteries placed on the EU market or in use. It forms part of the Ecodesign Regulation for Sustainable Products (ESPR), which aims to expand the sustainable products framework.
Under the new EU Battery Regulation (EU) 2023/1542, new light transport (LMT) batteries will be required to meet the following requirements before entering the EU market:
Carbon Footprint Declaration and Labeling
These batteries will be required to provide a carbon footprint declaration and labeling. Companies must collect and calculate carbon emissions data for each battery lifecycle stage, including raw materials, production, transportation, end-of-life, and recycling. Furthermore, a carbon footprint classification is required.
Battery Passport
From February 18, 2027, all batteries must be labeled with a QR code. This QR code provides complete, up-to-date, and accurate information about the battery, including a Declaration of Conformity and a Due Diligence Report.
Recycled Rate Requirements
The regulation specifies the recycling rate for key raw materials in batteries. The recycling rate for batteries in light transport vehicles, such as electric vehicles, electric bicycles, and electric scooters, must reach 51% by 2028 and 61% by 2031.
These measures are intended to promote the EU's circular economy and achieve its carbon neutrality goals. In summary, the new EU battery regulations present both challenges and opportunities for battery manufacturers. They compel companies to enhance the environmental performance and transparency of their products, while also driving the industry's green, low-carbon transformation.
