The latest version of RoHS 2.0, Annex II Amendment Directive (EU) 2015/863, 2011/65/EU
The publication of the new RoHS 2.0 Amendment Directive (EU) 2017/2102: On November 21, 2017, the European Union (OJ) published RoHS Amendment Directive (EU) 2017/2102, amending the EU RoHS Directive (2011/65/EU). The amendments primarily modify the conditions of use for electrical and electronic equipment and recycled components, and the expiration date of the Annex III exemption list. It officially came into effect on December 11, 2017.
I. About RoHS Regulations: RoHS is a mandatory standard established by EU legislation. Its full name is the Restriction of Hazardous Substances Directive. This standard officially came into effect on July 1, 2006, primarily regulating the materials and processes used in electronic and electrical products to make them more beneficial to human health and environmental protection.
II. RoHS Directive Updates and Changes:
1. Initial Publication: RoHS 1.0 implementation from July 1, 2006 to January 2, 2013 (repeal) (process and timeframe: 7 years)
The European Union issued RoHS 1.0 Directive 2002/95/EC in 2002, stipulating that new electrical and electronic equipment placed on the EU market must not contain six hazardous substances: lead (Pb), mercury (Hg), cadmium (Cd), hexavalent chromium (Cr6+), polybrominated biphenyls (PBBs), or polybrominated diphenyl ethers (PBDEs). The regulations officially came into effect on July 1, 2006.
2. First Update and Revision: RoHS 2.0 Directive 2011/65/EU, effective until July 21, 2019. The EU issued RoHS 2.0 Directive 2011/65/EU on July 1, 2011, and it came into effect on July 21. (Transition period until January 2, 2013) It stipulated the repeal of RoHS Directive 2002/95/EC on January 2, 2013, and that EU member states legislated to implement the updated RoHS 2.0 Directive 2011/65/EU on January 3, 2013. The new RoHS 2.0 directive did not add any new items, but it did list DEHP, BBP, DBP, and HBCDD as priority candidates, though the EU did not mandate their implementation.
3. Second Revision: Amendment Directive (EU) 2015/863 to Annex II of RoHS 2.0 Directive 2011/65/EU, effective July 22, 2019.
On June 4, 2015, the European Union issued Directive (EU) 2015/863, amending Annex II of RoHS 2.0 Directive 2011/65/EU. This revised the list of restricted substances, removing hexabromocyclododecane (HBCDD) from the previous RoHS 2.0 candidate list and adding diphthalate phthalate (DIBP). DEHP, BBP, DBP, and DIBP were officially added to the Annex II restricted substances list. Annex II now contains ten substances subject to mandatory control. See the table below for details:

Following the publication of this revised directive, all EU member states are required to transpose it into their national regulations and implement it by December 31, 2016.
The implementation dates for the four newly added phthalates are as follows: (Transition period for the six substances in Directive 2011/65/EU to July 21, 2019) Considering that it will take time for companies to meet the new hazardous substance requirements, (EU) 2015/863 stipulates a corresponding transition period: all electrical and electronic products (except medical devices and monitoring instruments) must meet the new requirements from July 22, 2019, and medical devices and monitoring instruments will also be included in this control scope. The new requirements must be met from July 22, 2021. Furthermore, toys already subject to phthalate control under Article 51 of Annex XVII of REACH will not be subject to the control of DEHP, BBP, and DBP in this directive.
4. Third Revision: The EU published the updated RoHS 2.0 Directive (EU) 2017/2102 on November 21, 2017, which officially came into effect on December 11, 2017. (This revision did not add or remove any new items; only the following content was revised.)
Main Revisions:
✓ The definition of "professionally used non-road mobile machinery and equipment" has been modified.
✓ The requirements for restricted substances in Annex II also apply to all electrical and electronic products placed on the market with respect to the Directive from July 22, 2019 (these products are not covered by Directive 2002/95/EC).
✓ The requirements for restricted substances in Annex II should not apply to all electrical and electronic equipment placed on the market before July 22, 2019 (these products are not covered by Directive 2002/95/EC). (Outside the scope of EC)
✓ If reuse occurs within a closed business audit revenue system, and consumers have been notified of the reuse of the parts, the Appendix II restricted substances requirements do not apply to the following reused parts:
a. Parts recovered from electrical and electronic products placed on the market before July 1, 2006, and used in electrical and electronic products placed on the market before July 1, 2016;
b. Parts recovered from medical devices or monitoring and control instruments placed on the market before July 22, 2014, and used until 2024. c. Parts recovered from in vitro diagnostic medical devices placed on the market before July 22, 2016, and used in electrical and electronic products placed on the market before July 22, 2026;
d. Parts recovered from industrial monitoring and control instruments placed on the market before July 22, 2017, and used in electrical and electronic products placed on the market before July 22, 2027;
e. Parts recovered from electrical and electronic products other than those covered by Directive 2002/95/EC placed on the market before July 22, 2019, and used in electrical and electronic products placed on the market before July 22, 2029.
✓ For the exemptions listed in Annex III of July 21, 2011, unless the specified period is shorter, the maximum validity period for Category 11 of Annex I shall be updated to 5 years from July 22, 2019, while the validity periods for Categories I to X of Annex I remain unchanged.
III. Changes to the Annexes to the RoHS Directive:
Note! Claims of a newly released RoHS 3.0 are incorrect. There is currently no third version of the RoHS Directive; it is merely an expansion, not a revision, of RoHS 2.0 (2011/65/EU)!
Appendix I: Types of electrical and electronic products covered by this Directive
Appendix II: Maximum acceptable concentrations by weight of restricted substances and homogeneous materials as described in Chapter 4(1).
Appendix III: Requirements for exemptions under Article 4(1).
